If you use this website (“the Site”), you are regarded as having accepted the following terms and conditions (“the Terms”), which include our Privacy Policy and the Penguin Terms and Conditions of Sale where relevant, so please read and abide by them.
1. INTELLECTUAL PROPERTY
This is the website of Ladybird Books Limited (“Ladybird”), a subsidiary of Penguin Books Limited (“Penguin”). It is owned and operated by Penguin and the information and materials appearing on the Site ("the Content") are displayed for personal, non-commercial use only. All software used on the Site and all Content included on the Site (including without limitation the Site designs, text, graphics, logos, images, pictures, photographs, videos, audio, widgets, interactive features, advertisements and the selection and arrangement thereof) is protected by copyright, trade marks, database rights and other intellectual property rights and are owned by or licensed to Penguin or Ladybird or are otherwise used by Penguin and Ladybird as permitted by applicable law or regulation.
None of the Content may be downloaded, copied, reproduced, republished, posted, transmitted, stored, sold or distributed without the prior written permission of the copyright holder. This excludes the downloading of one copy of extracts from the Site on any single computer for personal, non-commercial home use only, provided that all copyright and proprietary notices are kept intact. Modification of any of the Content or use of any of the Content for any purpose other than as set out herein (including without limitation on any other website or computer network) is prohibited. 2. CHANGES TO THESE TERMS
Penguin reserves the right to add to or change these conditions of use and agrees to ensure that a note of the date and clause number of any such amendments will be included as part of the conditions. Any changes will be posted to this page and it is your responsibility as a user to ensure that you are aware of any such changes from time to time. Changes will become effective 24 hours after first posting and you will be deemed to have accepted any change if you continue to access the Site after that time.
3. USER INFORMATION
Penguin and Ladybird collect information on what pages are accessed or visited by consumers, as well as information volunteered by the consumer, such as survey information and/or site registrations. Penguin and Ladybird use this information for internal review, in order to improve the Content of the Site and to notify consumers about any updates to the Site.
Penguin and Ladybird guarantee that if you supply your postal and/or email address online you will only be sent the information for which you provided your address but if you do not wish to receive communications by post and/or email from Penguin or Ladybird in the future, or if you wish to be removed from mailing lists, please let us know by writing to Penguin Books Limited, Penguin Group (UK), 80 Strand, London WC2R 0RL, United Kingdom.
4. POSTING OR SUBMITTING CONTENT
You must be over 13 years old in order to register as a member and post any comments or materials. If you are under 16 years old, please obtain your parent or guardian’s permission before you register to post any comments or materials.
Penguin does not vet and is not responsible for any content, recommendation, information or materials which are posted or submitted in any area on the Site (“User Content”), including but not limited to member photographs, videos, discussion forums and blogs (together known as the "Community"). Any User Content within the Community is viewed and used by you at your own risk and Penguin does not warrant, in any respect, the accuracy or reliability of the User Content. The views expressed in the Community are those of the individuals and are not necessarily those of Penguin.
Penguin does not moderate User Content before it is posted on the Community but retains the right to delete, move, edit, update or otherwise alter User Content in any way, at our discretion and without notice.
You remain the owner of the copyright in any original User Content that you post or submit. You promise that your User Content is your own original work and you own the entire rights, title and interest in and to the User Content and/or you have all necessary licences, rights, consents and permissions to use and to authorise Penguin to use any and all intellectual property rights (including without limitation copyright) in such User Content to enable Penguin to use the User Content in the manner contemplated by the Terms.
By posting or submitting your User Content, you grant Penguin and Ladybird a non-exclusive, perpetual, royalty-free, worldwide sub-licensable licence to use, copy, reproduce, modify, edit, adapt, reformat, translate, publish, distribute, display and otherwise make available to the public any User Content you post or submit to us (whether in whole or in part or copies of the same) in any format or medium now known or developed in the future for the full period during which such rights subsist (including all renewals, revivals, reversions and extensions of the same) and thereafter to the fullest extent possible in perpetuity. If you do not want to grant Penguin and Ladybird these rights, please do not submit your User Content to us.
You authorise Penguin to grant, and Penguin hereby grants, to each user of the Community a non-exclusive licence to view, hear, read, stream, download, link to and otherwise access and use your User Content as permitted through the functionality of the Site and in accordance with the Terms.
You may use the Community only to post or submit User Content that is proper and appropriate to the Site. You will be solely responsible for your User Content and the consequences of posting or submitting it. You promise that you will not do any of the following:
i. post unlawful, defamatory, obscene, indecent, pornographic, harassing, threatening, offensive, harmful or otherwise objectionable content or content that incites racial, cultural or religious hatred (this includes text, graphics, video, programs or audio);
ii. delete any author attributions, legal notices or proprietary designations or labels in any content that is posted;
iii. falsify the origin or source of content that is posted;
iv. post content in a language other than English;
v. post content that violates the legal rights of others, in particular, material that contains the intellectual property rights of third parties unless you have obtained all necessary licences, rights, consents and permissions to use such content;
vi. advertise, promote or offer to sell any goods or services;
vii. contribute content with the intention of committing or promoting an illegal act;
viii. use inappropriate (e.g. vulgar or offensive) user names;
ix. post content that contains viruses or that may damage Penguin' or another user's computer;
x. reveal any personal information about yourself or anyone else (for example, email address, telephone number or postal address).
You hereby waive all moral rights or similar rights now existing or created in the future in any part of the world in respect of any User Content and grant to Penguin a non-exclusive, royalty-free, worldwide licence to use any name, user name, screen name, likeness, photograph, signature and/or biographical material you submit to us.
Penguin reserves the right in its sole discretion at any time to: (a) delete, remove, or suspend the whole or any part of the Community or User Content without notice and without incurring any liability; and (b) suspend or cancel a user’s membership if they seriously, wilfully or persistently ignore the above rules. If you find objectionable or offensive content or material in the Community please let us know as soon as possible by emailing ReportAbuse@penguin.co.uk.
5. PRICE AND AVAILABILITY OF TITLES
Whilst every effort is made to ensure accuracy of prices and availability of the titles featured on the Site, this cannot be guaranteed and price and availability information may change without notice.
6. LIABILITY DISCLAIMER
The Site is provided by Penguin in good faith but Penguin does not make any representations or warranties of any kind, express or implied, in relation to all or any part of the Site or the Content or any websites to which the Site is linked, and all warranties and representations are hereby excluded to the extent permitted by law.
The contents of the Site do not constitute advice and should not be relied upon in making, or refraining from making, any decision.
There is no guarantee that the Site will be free of infection by viruses or anything else which may be harmful or destructive. To the extent permitted by law, Penguin hereby disclaims all liability (howsoever arising) in connection with any loss and/or damage, arising out of or in connection with any use of, or inability to use, all or any part of the Content, the Site and/or any website to which the Site is linked, or any action taken (or refrained from being taken) as a result of using any of these.
7. LINKS TO THIRD PARTY WEB SITES
The Site may include links to third party Internet websites which are controlled and maintained by others. These links are included solely for the convenience of users and do not constitute any endorsement by Penguin of the sites linked or referred to, nor does Penguin have any control over the content of any such sites
8. SEVERANCE
If any of these Terms is held by a court of law in any territory to be invalid, illegal or otherwise unenforceable, then, to the extent that it is held to be so, and with regard to the relevant territory only, that provision shall be severed and deleted from these Terms, provided that the remaining provisions of these Terms shall remain binding and enforceable and the severed provision shall also remain so in all other territories.
9. GOVERNING LAW
These Terms shall be governed by, and construed in accordance with, English law, and any disputes that may arise under or in relation to these Terms shall be subject to the jurisdiction of the courts of England.
